By accessing or using the website at altar.gallery (the "Site") or any services offered by ALTAR Gallery S.R.L. ("ALTAR," "we," "us," or "our"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.
If you are using the Site on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
These Terms apply to all visitors, users, collectors, and others who access or use the Site.

All information on the Site is provided for general informational purposes and is subject to change without notice. ALTAR reserves the right to modify, suspend, or discontinue any part of the Site or services at any time.
All content on the Site — including but not limited to text, editorial copy, design, layout, logos, photographs of artworks, and the ALTAR brand identity — is the intellectual property of ALTAR Gallery S.R.L. or its licensors, protected under Romanian Law No. 8/1996 on Copyright and Related Rights and applicable EU and international copyright law.
You may not reproduce, distribute, modify, transmit, publish, or create derivative works from any content on this Site without our prior written consent.
All artworks displayed on this Site remain the intellectual property of their respective artists. The display of artworks on the Site does not transfer any copyright or reproduction rights to visitors. Any reproduction, including digital capture, screenshot, or printing of artwork images, for purposes other than private, non-commercial reference is strictly prohibited without written authorisation from the artist and ALTAR Gallery.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes only. This licence does not include the right to scrape, aggregate, or systematically download content.
Many works are available by inquiry only. Submitting an inquiry does not constitute a binding purchase. A sale is complete only upon written confirmation from ALTAR Gallery and receipt of payment in full.
Prices are quoted in Euros (EUR) and exclude VAT, shipping, insurance, and import duties unless stated otherwise. ALTAR reserves the right to adjust prices without notice prior to confirmed sale.
All artworks sold through ALTAR Gallery are guaranteed to be authentic works by the stated artist. Each work is sold with a certificate of authenticity. Condition reports are available upon request prior to purchase.
Artworks are professionally packed and shipped at the buyer's risk and cost unless otherwise agreed in writing. Title and risk pass to the buyer upon collection by the carrier.
Due to the unique and high-value nature of original artworks, all sales are generally final unless the work arrives materially different from its description or damaged in transit. Any claim must be made in writing within 48 hours of delivery with photographic evidence. Consumer right-of-withdrawal provisions under EU Directive 2011/83/EU apply where applicable (see Section 12).
ALTAR Gallery complies with applicable anti-money laundering (AML) and know-your-customer (KYC) requirements under Romanian Law No. 129/2019 and EU Directive 2018/843. For transactions above regulatory thresholds, we are required to verify the identity of the buyer and may request supporting documentation. We report suspicious transactions as required by law.

The Site may contain links to third-party websites or services not owned or controlled by ALTAR. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We recommend reading the privacy policy of any site you visit.
The Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable Romanian or EU law.
To the fullest extent permitted by applicable law, ALTAR Gallery S.R.L., its directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business interruption — arising from:
In no event shall our total liability to you for all claims exceed the greater of (a) the amount you paid to ALTAR in the 12 months preceding the claim, or (b) €100 (one hundred euros).
These limitations apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless ALTAR Gallery S.R.L. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any third-party rights.
We may suspend or terminate your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms. Upon termination, your right to use the Site will cease immediately. Provisions that by their nature should survive termination shall do so, including intellectual property provisions, disclaimers, indemnity, and limitations of liability.
These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. You irrevocably agree that the courts of București, Romania shall have exclusive jurisdiction to settle any dispute arising from or in connection with these Terms, subject to mandatory consumer protections applicable in your country of residence.

Under EU Directive 2011/83/EU and Romanian Government Ordinance No. 34/2014, consumers purchasing goods online have a 14-day right of withdrawal from the contract, without giving any reason, starting from the day you receive the goods. To exercise this right, you must inform us of your decision to withdraw using the contact details below before the withdrawal period expires.
Exception: The right of withdrawal does not apply to goods made to a consumer's specifications or clearly personalised, or to goods which by their nature cannot be returned. Original artworks that have been specifically acquired following a collector inquiry may be subject to this exception; we will clarify this in writing at the time of purchase.
Under Romanian Consumer Protection Law (OG 140/2021 transposing EU Directive 2019/771), artworks sold to consumers carry a minimum 2-year legal guarantee against lack of conformity. This is in addition to any commercial guarantee we provide.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a new "Last updated" date, and by email notification to registered users or collectors where appropriate.
Your continued use of the Site after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you should stop using the Site.
